Terms of Service
These terms are an agreement between you and Stephanie Klahre, doing business as pocket planter ("we", "us"), Knoxville, Tennessee, USA, for the pocket planter app and website. By creating an account or using the app you accept them. If you do not agree, please do not use pocket planter.
1. who can use pocket planter
You must be at least 18 years old and able to enter into a contract. You are responsible for keeping your login details safe and for everything done through your account. Tell us at hello@pocketplanter.app if you think your account has been used without permission.
2. beta software
pocket planter is currently in beta. Beta software is pre-release: it may contain errors, features may change or be removed, and in rare cases data may need to be reset. We will do our best to warn you first. If you install through TestFlight or Google Play testing, their terms also apply. Any feedback, ideas or suggestions you send us may be used freely to improve the product, without obligation to you.
3. the service and what it costs
During the beta every feature is free: unlimited plants, identification, diagnosis, the planter assistant, care scheduling and photo timelines. Some features have fair-use limits to keep costs sane.
If we introduce paid plans, we will announce it in the app at least 30 days before any existing feature moves behind a paywall. Subscriptions, when offered, will be sold through the Apple App Store or Google Play, renew automatically until cancelled in your store account, and follow the refund rules of the store you bought from.
4. plant advice, identification and AI: please read this
pocket planter gives general plant-care information generated by automated systems, including artificial intelligence (plant identification and diagnosis by Kindwise, and the planter assistant by Google's Gemini), curated species data and weather forecasts.
- It can be wrong. Species identification, health diagnosis, toxicity information and care advice are suggestions, not facts, and are not a substitute for advice from a qualified horticulturist, agronomist, veterinarian or doctor.
- Never rely on the app to decide whether a plant is safe to eat or safe around children or pets. If a person or animal may have swallowed something harmful, contact poison control or a veterinarian immediately.
- Weather data is provided by OpenWeather and may be delayed or inaccurate.
- You are responsible for the decisions you make about your plants, your home and your animals.
5. your content
You own the photos, notes and other content you add. So that the app can work, you give us a worldwide, non-exclusive, royalty-free licence to store, process, transmit to the identification and AI providers named in our Privacy Policy, back up and display that content, only to operate, secure and improve pocket planter for you. The licence ends when you delete the content or your account, except for copies in our backups, which disappear when the backups rotate (Supabase keeps daily backups for a limited period, 7 days on the current plan).
You confirm you have the right to upload what you upload. We may use aggregated, de-identified statistics (for example, how many users grow a species) that cannot be traced back to you.
6. acceptable use
- Do not use the app for anything unlawful, to harass anyone, or to upload content you have no right to share.
- Do not try to break, overload, scrape or reverse engineer the app or our servers, or to bypass usage limits.
- Do not use the planter assistant to generate harmful, deceptive or abusive content, or in ways that break Google's Gemini API usage policies.
If you see an AI response you think is wrong or inappropriate, tell us through "send feedback" or at hello@pocketplanter.app.
7. notifications and email
Care reminders are optional and controlled in Profile → Care reminders and in your phone settings. We send only transactional email (account, hand-offs and waitlist you requested, replies to you). We do not send marketing email to app users during the beta; if that changes, every such email will include an unsubscribe link and our postal address. Emails to the website waitlist about the launch also carry both.
8. product links
Some screens link to products on third-party stores (for example a search on Amazon) to help you find supplies. We do not sell those products and are not responsible for them. If we ever earn a commission from such links we will say so in the app.
9. our intellectual property
The pocket planter name, the planter mascot, the design, the source code and the curated plant database belong to us or our licensors and are protected by copyright and trademark law. You get a personal, non-transferable licence to use the app on devices you own. You may not copy, modify, distribute, sell or create derivative works from any part of it without written permission.
Copyright complaints: if you believe something in pocket planter infringes your copyright, email hello@pocketplanter.app with your contact details, the work you own, where the material appears, a statement that you believe in good faith the use is not authorised, and a statement, under penalty of perjury, that your notice is accurate and that you own the right or act for the owner. We will remove material that infringes and close the accounts of people who infringe repeatedly.
10. app stores
If you downloaded the app from Apple, the app is licensed under Apple's standard Licensed Application End User License Agreement and these terms. The agreement is between you and us, not Apple; we, not Apple, are responsible for the app, its maintenance, support, warranty and any claims about it. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you. Equivalent rules apply to Google Play.
11. no warranty
pocket planter is provided "as is" and "as available", without warranties of any kind, express or implied, including fitness for a particular purpose, accuracy or uninterrupted operation. Some places do not allow some of these exclusions, so they may not all apply to you.
12. limits on our liability
To the extent the law allows, we are not liable for indirect, incidental, special, consequential or punitive damages, or for lost plants, profits, data or goodwill, arising from your use of the app. Our total liability for any claim is limited to the greater of fifty US dollars (US$50) or the amount you paid us in the twelve months before the claim.
Nothing in these terms limits liability for death or personal injury caused by our negligence, for fraud, for gross negligence or wilful misconduct, or for anything that cannot be limited by law.
13. your responsibility to us
If a third party brings a claim against us because you broke these terms or the law while using the app, you agree to cover the reasonable costs and damages that result.
14. ending the agreement
You can stop at any time by deleting your account in Profile → Delete my account. We may suspend or close accounts that break these terms, abuse the service or create risk for other users, and will tell you why unless the law prevents it. Sections 4, 5 (for backups), 9 and 11 to 16 survive termination.
15. governing law and disputes
These terms are governed by the laws of the State of Tennessee, USA, without regard to its conflict-of-laws rules. Any dispute will be brought in the state or federal courts located in Knox County, Tennessee, and you consent to their jurisdiction. Either of us may bring an eligible claim in small-claims court instead. If you live in the EU or UK, you keep any mandatory consumer protections of your home country.
16. changes and the rest
We may update these terms as the app evolves. For material changes we will give at least 14 days' notice in the app or by email, and the app will ask you to accept the new version; we record which version you accepted and when. Continuing to use the app after that is acceptance. If a part of these terms is unenforceable, the rest still applies. These terms and the Privacy Policy are the whole agreement between us about pocket planter.
